Getting your Employee Benefits House in Order

Event Overview:
The Total Rewards Committee of Cleveland SHRM in collaboration with the Worldwide Employee Benefits Network (WEB) NEO Chapter is pleased to present Getting your Employee Benefits House in Order.

Do you want to be a hero or a goat?  Administering employee benefit plans is a difficult and complicated task.  Non-compliance or poor tax planning can be very costly and can, potentially, reduce the overall value of your company.  This program will review steps every company should be considering taking now to prepare for the future…whether it includes an eventual sale of your company or not.  The moderators will lead our employee benefits experts to discuss some of the employee benefits experiences they have dealt with in handling thousands of transactions and go through each of the areas of employee benefits and identify key areas of non-compliance and opportunities.

Ann focuses her practice on employee retirement and health and welfare benefits, ERISA, employee stock ownership plans (ESOPs), and executive compensation. She counsels employers on the design, administration, problem resolution and termination of their employee benefit and executive compensation programs. Ann also represents parties in ERISA litigation, ranging from matters such as class action pension claims, breach of fiduciary duty and prohibited transaction claims, to bankruptcy trustee claims involving 403(b) plan assets.

Ann is Band 2-ranked in Chambers USA 2019 for her work in Employee Benefits & Executive Compensation (Ohio), where sources note that she is “adept at applying the law to unique circumstances and driving towards strategic goals.” Clients describe her as responsive and knowledgeable,” and add: “Her communication skills are first-rate.”

John has extensive experience assisting mid-sized and Fortune 500 companies with employee benefits and executive compensation issues and opportunities, including benefits issues arising in mergers and acquisitions, and bankruptcies, and the design and implementation of qualified and non-qualified retirement and benefits programs including ESOPs, defined benefit and defined contribution plans, cash balance programs, non-qualified deferred compensation plans, stock option and other equity participation programs. 

John was the national President of the Worldwide Employee Benefits Network and a founding member of the Cleveland Society of Human Resources’ Total Rewards Association.  John has been recognized many times as a Best Lawyer and Super Lawyer and frequently speaks on various employee benefits topics and has been quoted and interviewed in numerous magazines and newspapers regionally and nationally. John earned his J.D. from Case Western Reserve University School of Law. He received a B.S., cum laude, from Indiana University.

John joined Willis Towers Watson in 2001 and is a Senior Consultant in the Health and Benefits consulting practice. He works from the company’s Cleveland office and has focused on assisting national and global employers in developing benefits strategy and design and in evaluating health plan and cost sharing alternatives. He has been extensively involved in projects such as Health plan strategy, Mergers and acquisitions, Budget rate and employee contribution development, Evaluating market competitiveness of employers’ benefit programs, Benefit assessment and optimization, Care management strategies, and Benefit plan pricing.

John has over 25 years of experience in the consulting, health care management and managed care industries. John holds a B.S. degree in chemistry from Gannon University (Pennsylvania) and an M.H.A. degree from Ohio State University. He is currently working toward his CEBS designation. He is also a licensed Accident and Health, Life and Variable Annuities agent in the State of Ohio and frequently serves as a guest speaker on benefit topics.

Al is one of two founding partners of the Organizational Consulting Group, L.L.C.  He advises a wide variety of clients, among them publicly-traded, closely-held, and tax- exempt organizations, on their compensation needs.  These needs cover Executive compensation, Deferred compensation, Sales compensation, Incentive compensation, Intermediate sanctions, Private inurement, Salary management, Performance management, and Related areas.

Al has had experience as the Regional Performance Management and Compensation Practice Leader for KPMG Peat Marwick, LLP, and Deloitte & Touche; the National Head of Sales Compensation Consulting for KPMG Peat Marwick, and the National Head of Performance Management and Compensation Consulting for Laventhol & Horwath. Al is a graduate of New York University Law School and the Stern School of Business. He received both his J.D. and M.B.A. degrees in June 1977.

Jeff has been in the insurance business for thirty years, advising middle market companies on their insurance and risk management programs.  In 2012, he co-founded (TRA) Transactional Risk Advisors– a specialty insurance brokerage offering innovative coverage solutions that can facilitate closing of mergers, acquisitions, divestitures, restructuring, and workouts.  TRA was acquired by Oswald Companies in 2016, where Jeff now leads the Transactional Risk practice. 

He has a Bachelor of Arts degree from Bowling Green State University and also holds the Certified Risk Manager (CRM) designation as well.

David Kulchar

From 1998 to Present, Mr. Kulchar has worked for The James B. Oswald Company (JBO). In 1999, Mr. Kulchar established Oswald Financial, Inc. (OFI), a subsidiary of JBO. He is the Executive Vice President and Director of Retirement Plan Services at OFI. Mr. Kulchar currently directs and manages OFI’s strategic operations. OFI’s primary focus is supporting plan sponsors through design, implementation, investment monitoring servicing and participant education. Mr. Kulchar has over 25 years of experience in the retirement plan industry and is nationally recognized in the area of qualified retirement plans. Mr. Kulchar has been selected as one of the top 20 advisors in the country by Plan Sponsor magazine for the past three years*, he was voted as a Top 10 Retirement Plan Advisors by DCP/Boston Research, nominated for ASPPA Leadership Award, and nominated by 401(k) Wire as one of the most influential people in the industry. Mr. Kulchar is an Accredited Investment Fiduciary designee, Investment Advisor Representative under LPL Financial, and is frequently sought after as a speaker for national events regarding the retirement plan industry. He serves on the advisory boards of select retirement plan providers, associations and nonprofit organizations.
